Terms of Service

1. About these terms

Gopherd is the name we use as independent developers of utility apps. “We,” “us,” and “our” refer to the independent developers behind Gopherd. These terms apply to gopherd.com and apps that link to these terms, collectively the “Services.”

By using the Services, you agree to these terms. If you do not agree, do not use the Services. If a particular app or feature has additional terms, those terms apply to that app or feature as stated. Applicable app store terms also apply to downloads and purchases through that store.

2. Eligibility and responsible use

You must be legally able to agree to these terms or have the permission of a parent or guardian where required. Follow the age requirements shown for the app you use.

Use the Services lawfully and only on devices, accounts, and information you are authorized to access. You must not use the Services to infringe others’ rights, distribute harmful code, bypass access controls, interfere with the Services, or access another person’s information without permission.

3. License and ownership

Subject to these terms and applicable app store rules, we grant you a limited, non-exclusive, non-transferable license to use our apps on devices you own or control for their intended purposes, including legitimate personal or work tasks. Apps are licensed, not sold.

We or our licensors retain ownership of the Services, including their software, designs, and branding. You may not redistribute, sell, sublicense, or copy our apps except as permitted by these terms or applicable law. Restrictions on modification or reverse engineering do not apply where applicable law or an open-source license permits those activities. Third-party and open-source components remain subject to their respective licenses.

You retain any rights you have in files and other content you use with the Services. You are responsible for having permission to use that content and for keeping appropriate backups.

4. Purchases and subscriptions

Some apps may offer paid features, one-time purchases, or subscriptions. The price, billing period, included features, and any trial conditions will be shown before you confirm a purchase.

Payments are handled by the relevant app store or payment provider under its terms. Subscriptions may renew automatically unless you cancel according to the terms shown at purchase. Manage or cancel a subscription through the provider where you purchased it; uninstalling an app does not cancel a subscription.

Refunds and billing disputes are handled under the applicable provider’s policies and applicable law. Nothing in these terms removes any mandatory right to a refund or other consumer remedy.

5. Privacy and permissions

Our Privacy Policy explains how we handle information. Read any app-specific privacy notice and permission requests before using the relevant features. You can manage device permissions in your device settings, although disabling a permission may prevent a related feature from working.

6. Third-party services

The Services may link to or work with third-party platforms, websites, or services. Those providers have their own terms and privacy policies. We do not control their availability or operation. Review their terms before using them or providing information to them.

7. Updates and availability

We may update the Services to improve functionality, fix problems, or respond to platform changes. Features and compatibility may change over time. We do not promise that every feature will always be available on every device or operating system.

If we discontinue a paid service or make a material change affecting an existing purchase, we will provide notice and any remedies required by applicable law or the relevant purchase terms.

8. Disclaimers

To the extent permitted by applicable law, the Services are provided “as is” and “as available,” without warranties of uninterrupted operation, complete accuracy, or suitability for a particular purpose. Check important results independently and maintain backups before relying on an app to process your information.

Nothing in these terms excludes warranties, guarantees, or consumer rights that cannot legally be excluded.

9. Limitation of liability

To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising from use of, or inability to use, the Services, including lost profits or loss of data.

This limitation does not apply to fraud, willful misconduct, or any liability that applicable law does not allow us to limit or exclude. Your mandatory consumer rights remain unaffected.

10. Ending use

You may stop using the Services at any time. We may restrict access or terminate a license if you materially breach these terms or misuse the Services, subject to applicable law. Where appropriate, we will provide notice and an opportunity to resolve the issue.

After a license ends, you must stop using the relevant app. Ending use does not automatically cancel a subscription; cancellation must be completed through your purchase provider.

11. Changes to these terms

We may revise these terms and will update the date at the top of this page. We will give additional notice of material changes and seek agreement where required by law. If you disagree with updated terms, stop using the affected Services. Changes do not remove rights that have already arisen under an existing purchase.

12. General terms and contact

If a provision is found unenforceable, the remaining provisions continue to apply. A delay in enforcing a provision is not a waiver of it. Nothing in these terms limits the protections or access to courts available to you under mandatory local law.
